TakiDa LLC ("TakiDA")

1. Diagnostic Fee

The service call / diagnostic fee is non-refundable once the technician arrives on-site and begins the diagnostic evaluation, regardless of whether a repair is completed. If the repair estimate is approved, the diagnostic fee is credited toward the total cost of the repair.

2. Estimates & Authorization

All repair work requires electronic approval of the estimate. Approval authorizes TakiDA to perform the listed services at the stated price. Estimates are valid for 30 days from the date issued. Pricing may change after this period, or if parts or supplier costs change before work is authorized. Any additional work not included in the original estimate requires separate approval.

3. Payment Terms

Payment is due immediately upon completion of service unless otherwise agreed in writing. For special-order parts, commercial equipment, or high-value components, a deposit of up to 50% may be required prior to ordering. The remaining balance is due upon completion. Special-order and non-stock parts are non-refundable once ordered. Any deposit applied to such parts is forfeited if the customer cancels after the order has been placed. Electronic approval of the estimate authorizes TakiDA to charge the approved amount to the payment method on file. Any dishonored check or bank draft is subject to a $25 processing fee, and past-due balances may accrue interest at the maximum rate allowed by Texas law. All payments are final once the service has been completed.

4. Access & Site Conditions

The customer must provide safe, clear, and unobstructed access to the equipment. TakiDA is not responsible for additional labor or delays resulting from improper installation, restricted access, or prior unauthorized repairs. Appointment arrival times are estimated windows and are not guaranteed to the exact minute. TakiDA reserves the right to decline or discontinue service where site conditions are unsafe — including but not limited to mold, pest or rodent infestation, hazardous wiring, or aggressive animals. The diagnostic fee remains due if the technician has already arrived on-site.

5. Diagnostic Limitations

Diagnosis reflects the condition of the equipment observed at the time of service. Intermittent, load-dependent, or environmental faults may not be reproducible during a single visit and are not guaranteed to be identified in one appointment. Additional diagnostic visits may be required for such conditions.

6. Damage Waivers

Certain repairs carry inherent risk. By authorizing service, the customer accepts the following waivers; if any waiver is found unenforceable, the remaining waivers stay in effect.

  • Moving the appliance: Moving an appliance to access components carries risk of damage to the unit and to surrounding areas including flooring, cabinetry, and countertops. The technician is not required to move the appliance; where he agrees to do so, the customer holds TakiDA harmless from any damage arising from such movement.
  • Working with water: Equipment connected to the building's plumbing carries inherent risk of leakage or flooding from component failure or imperfect connections. Except for cases of clearly proven negligence by the technician, the customer holds TakiDA harmless from any resulting damage.
  • Cooling equipment: Refrigeration systems consist of complex components that can fail without warning. Service or repair may not restore intended performance and may result in food spoilage or loss of use, and TakiDA does not accept responsibility for such risks.
  • Glass / ceramic cooktops: Lifting a glass or ceramic cooktop to access components below carries an inherent risk of breakage due to factory adhesive. While the technician exercises due care, TakiDA does not accept responsibility for such breakage.

7. Warranty

TakiDA provides a 90-day (3-month) labor warranty unless otherwise stated in writing. Parts installed by TakiDA carry a 1-year warranty against manufacturer defects only. Labor to replace warranty parts is not included unless otherwise stated in writing. If a defect in parts or workmanship is discovered during the warranty period, the customer must promptly notify TakiDA, and TakiDA's obligation and the customer's exclusive remedy is limited, at TakiDA's option, to replacement of the defective part or workmanship or refund of the amount paid for that part or service.

This warranty does not cover: misuse, neglect, power surges, water damage, rodent damage, improper ventilation, restricted airflow, normal wear and tear, or unrelated system failures; cosmetic or non-functional parts including glass, trim, knobs, panels, racks, baskets, shelves, doors, and structural parts; plumbing supply water lines; any appliance moved from the location where it was originally serviced; and appliances for which parts are no longer available from the manufacturer.

This warranty is non-transferable and applies only to the original customer at the original service address. Any warranty claim requires inspection by our technician, and additional service charges may apply if the issue is not related to the original repair. Repairs may affect or void an existing manufacturer warranty on the equipment; it is the customer's responsibility to verify manufacturer coverage before authorizing work.

THE WARRANTIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

8. Customer-Supplied Parts

No warranty is provided on customer-supplied parts. Labor associated with the installation of such parts is non-refundable.

9. Replaced Parts

Parts removed and replaced during service are disposed of by TakiDA unless the customer requests their return at the time the repair is approved.

10. Limitation of Liability

TakiDA is not liable for food loss, loss of business income, product spoilage, downtime, or any incidental, indirect, or consequential damages unless directly caused by proven negligence. In no event shall TakiDA's total liability exceed the total amount paid by the customer for the specific service giving rise to the claim. This limitation does not apply to claims for personal injury.

11. Communication & Text Messaging

TakiDA may communicate via phone, SMS, or email regarding scheduling, approvals, invoices, and service updates. By providing a phone number, the customer consents to receive service-related calls and text messages from TakiDA. Message frequency varies. Message and data rates may apply. 12. Cancellation / No-Show Fee

A cancellation or no-show fee of up to $99 may be charged if the appointment is canceled with less than 24 hours' notice, or if the technician is unable to access the property.

13. Return Visit Fee

Additional service fees may apply for return visits not related to warranty work.

14. Force Majeure

TakiDA is not responsible for delays or inability to perform caused by events beyond its reasonable control, including parts availability, supplier delays, weather, or other force-majeure events.

15. Governing Law & Venue

This agreement shall be governed by the laws of the State of Texas. Any dispute shall be handled in the courts of Williamson County, Texas.

16. Severability & Entire Agreement

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. These terms constitute the entire agreement between the customer and TakiDA and supersede any prior verbal or written discussions.

17. Agreement Acknowledgment

By electronically approving the estimate, the customer acknowledges and agrees to all terms stated above.
